Terms of Service
Effective April 26, 2026
Welcome to Seya ("Seya", "we", "us"). These Terms of Service ("Terms") form a binding agreement between you and Seya Inc., a company based in Montréal, Québec, Canada, and govern your access to and use of our website, mobile experience, and related services (collectively, the "Platform").
By creating an account, browsing, or booking a service through Seya, you confirm that you have read and agree to these Terms. If you do not agree, please do not use the Platform.
1. Who we are
Seya is a marketplace that connects clients ("Clients") with independent beauty and wellness professionals ("Providers"). We are not the provider of the services offered through the Platform. Each Provider is an independent business solely responsible for the services they deliver.
2. Eligibility
- You must be at least 18 years old, or the age of majority in your province or country, to use Seya.
- You must provide accurate, current, and complete information when creating your account.
- You are responsible for keeping your login credentials secure and for all activity under your account.
3. Bookings & payments
When you book a service, you enter into a direct contract with the Provider. Seya facilitates discovery, booking, scheduling, payment processing, and dispute resolution, but is not a party to that service contract.
- Prices, deposits, deposit policies, and cancellation rules are set by each Provider and shown at the time of booking.
- Payments are processed by our payment partner, Stripe, Inc. Seya does not store your full payment card details.
- Seya charges a service fee on each booking, disclosed at checkout.
- Wallet credits, cashback, and promotional discounts are subject to additional terms shown in your wallet and at checkout.
4. Cancellations & no-shows
Each Provider sets their own cancellation window and deposit / no-show policy. Please review these carefully before confirming a booking. See our Refund Policy for how refunds and deposits are handled across Seya.
5. Conduct
You agree not to:
- Use the Platform for any unlawful purpose or in violation of these Terms.
- Harass, threaten, defame, or discriminate against any Provider, Client, or member of our team.
- Submit false reviews, manipulate ratings, or impersonate another person or business.
- Attempt to bypass the Platform to take a confirmed booking off-platform in order to avoid fees.
- Reverse-engineer, scrape, or interfere with the Platform’s technical operation.
6. Reviews & user content
You may submit reviews, photos, and other content. You retain ownership of your content but grant Seya a worldwide, royalty-free, non-exclusive licence to host, display, reproduce, and distribute it in connection with operating and promoting the Platform. You are solely responsible for what you post and confirm it is truthful and does not infringe anyone else’s rights.
We may remove content that violates these Terms, our community guidelines, or applicable law.
7. Provider listings
Provider profiles, services, photos, and policies are submitted by Providers themselves. We review applications and verify documents in good faith but do not independently guarantee the accuracy of every listing or the quality of every service. Your booking with a Provider is at your own discretion and risk.
8. Disputes
If you have a problem with a booking, please first contact the Provider. If you cannot resolve it together, you may open a dispute through your booking page. Seya will review the evidence from both sides in good faith and may issue a refund, partial refund, or wallet credit at its reasonable discretion. Decisions are final but do not waive any statutory consumer-protection rights you may have under applicable Québec or Canadian law.
9. Intellectual property
Seya, the Seya logo, the Platform’s design, software, and content (other than user-submitted content) are owned by Seya Inc. or its licensors and are protected by copyright, trademark, and other laws. You may not copy, modify, or redistribute them without our written permission.
10. Disclaimers
The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Seya disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error free, or secure.
11. Limitation of liability
To the maximum extent permitted by law, Seya, its directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising out of or in connection with your use of the Platform. Our total aggregate liability for any claim related to the Platform will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) CAD $100. Nothing in these Terms limits any liability that cannot be limited by applicable law.
12. Indemnification
You agree to indemnify and hold harmless Seya and its team from any claim, damage, or expense (including reasonable legal fees) arising out of your use of the Platform, your content, your interactions with other users, or your breach of these Terms.
13. Termination
You may close your account at any time. We may suspend or terminate your access to the Platform if we reasonably believe you have violated these Terms, our policies, or applicable law, or to protect the safety of other users. Sections that by their nature should survive termination (including payments owed, intellectual property, disclaimers, and limitations of liability) will survive.
14. Governing law & venue
These Terms are governed by the laws of the Province of Québec and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the Platform shall be brought exclusively in the competent courts of the District of Montréal, Québec, unless mandatory consumer-protection laws require otherwise.
15. Changes
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Platform at least 14 days before they take effect. Continued use of Seya after the effective date means you accept the updated Terms.
